The article begins with a review of the structural differences between act consequentialist theories and human rights theories, as illustrated by Amartya Sen's paradox of the Paretian liberal and Robert Nozick's utilitarianism of rights. It discusses attempts to resolve those structural differences by moving to a second-order or indirect consequentialism, illustrated by J.S. Mill and Derek Parfit. It presents consequentialist (though not utilitarian) interpretations of the contractualist theories of Jürgen Habermas and the early John Rawls (Theory of Justice) and of (...) the capability theories of Sen and Martha Nussbaum. It also discusses two roles that well-being or a surrogate for well-being typically plays in theories of human rights: (a) well-being plays a role in the justification of at least some exceptions to human rights principles; and (b) some human rights seem to be best understood as rights to some level of well-being or expected well-being (or of a surrogate for one of them). It reviews two consequentialist challenges to the moral adequacy of non-consequentialist accounts of human rights, one based on a duty to relieve suffering and the other generated by Parfit's Non-Identity Problem, and concludes with a contrast between two ways of looking at the history of the development and implementation of human rights conventions and laws. The project began in the 1960s, and the initial results for the Middle Ages were published sequentially as articles in Traditio between 1967 and 1974, and the inventory for the period from 1500 to 1650 appeared in Studies in the Renaissance and Renaissance Quarterly between 1974 and 1981. The project was modeled along the lines of two great research tools achieved earlier in the twentieth century at Freiburg by Friedrich Stegmüller, namely his Repertorium Commentariorum in Sententias Petri Lombardi (1947) and his Repertorium Biblicum Medii Aevi (1940–). Now, through the Unione Accademica Nazionale and SISMEL, both of Lohr's inventories in revised and expanded form are being published as stand-alone volumes. The first two that appeared were Latin Aristotle Commentaries, II: Renaissance Authors (Subsidia VI, 1988), followed by Latin Aristotle Commentaries, III: Index initiorum—index finium (Subsidia X, 1995). The two volumes being reviewed here are the next two installments.The first of these, the Bibliography of Secondary Literature, is a much-expanded version of Lohr's Commentateurs d'Aristote au moyen-âge latin: Bibliographie de la littérature secondaire récente, Vestigia 2 (Fribourg-Paris, 1988). The intent of that volume was, as the title indicates, to provide a list of the scholarly literature on Aristotelian commentaries since the publication of the articles in Traditio, as well as some older literature that had not been included earlier in the entries for each author. The present version of this work is more than twice as large as the 1988 version, adding books and articles that were missed in the earlier bibliographies as well as publications since 1986 (the cutoff date for the earlier edition). Moreover, the Commentateurs d'Aristote provided a bibliography only for medieval commentaries, while the new Bibliography of Secondary Literature begins with a section covering literature about translations of the works of Aristotle and their Wirkungsgeschichte, then [End Page 141] the section for the literature on medieval authors, and finally the section for bibliography on Renaissance authors.The organization of the bibliography for authors that have generated extensive literature is more complex than for the others. The longer bibliographies are divided into works concerned with biographical information and manuscripts; general accounts; and, depending on the contributions of a specific author, sections on logic, metaphysics, natural philosophy, and practical philosophy. Within each of these sections the literature is arranged by date of publication, moving from the older to the most recent (limited, of course, by the cutoff date at which this volume was prepared for publication, apparently around 2003). The principle of inclusion was broad, citing works that relate tangentially to the subject areas of Aristotelian philosophy mentioned. And although bibliographies of this kind should be made available on the Internet, where they can be continually expanded and updated, it is useful and pleasurable to have such a volume on the shelf at one's fingertips, particularly for those of us still attuned to a print culture.The other volume, Latin Aristotle Commentaries, I.2: M–Z, published in 2010, is the second half of the revised edition of medieval authors and their commentaries on Aristotle's works. Some bibliography is included here in the individual entries, but only what relates to the manuscripts. There are many challenges to be met when writing an introductory treatise on an academic topic. The subject matter must be presented in a simple but not oversimplified manner. Enough theory must be included to ground the discussion of specific issues but not so much as to overwhelm or bore the readers. The text should be long enough to do justice to the subject matter but short enough to be readily accessible, especially for readers such as healthcare professionals, whose primary (...) concerns lie elsewhere.There are additional challenges in a relatively novel interdisciplinary field such as bioethics. The scope and methodology of bioethics are matters of great controversy, as are its relations with related subjects such as professionalism and human rights. The field is so broad that a single author cannot claim expertise on all topics. Rivalries between law and ethics and among medicine, other health professions, and disciplines such as philosophy complicate efforts to produce a broadly acceptable text. Finally, national and cultural differences pose major challenges to anyone trying to write for a truly international readership.The difficulty of meeting all these challenges in producing the WMA Medical Ethics Manual provides ample opportunity for criticism, especially from bioethics experts. The three expert reviewers of the manual in this issue of the journal are remarkably restrained in pointing out its shortcomings.1–3 I am grateful for both their positive evaluations and their constructive criticism. In what follows, I will respond to each of them in turn, focusing in particular on their suggestions as to how the Manual could have been improved.Before addressing these suggestions, I wish to clarify a matter raised by Søren Holm, namely, to what degree the manual …. This article recognises that any attempt to theorise the first wave globally must specify the use of the term ‘global’, so as not to elide the specificity of local differences, and must critically account for how feminist struggles among postcolonial, indigenous women are intertwined with a resistance to a history of colonialism and racial domination. While more than a demand for equal access to the symbolic order on the basis of gender alone, Western feminists must study carefully the cultural and (...) gender implications of work by indigenous women in postcolonial contexts which do not easily fit into familiar theoretical paradigms that mimic the development of Western feminism, given the heterosexist biases of Western feminism historically. To what extent does the very form of historicisation of feminist struggles in the West repeat the colonising gesture when attempting to historicise the struggles of women in postcolonial contexts where the three waves of feminism as an organising framework, however loosely constructed, are transplanted to locations where they did not emerge historically? Through an examination of feminist work coming out of southern Africa, the article argues how attention to affective and erotic bonds between women in Lesotho provides a critical response to the heterosexist biases of African cultural nationalism, as well as to the colonising tendencies of feminist and queer enquiry in the West that do not account for the primacy of the performativity of sexual expression rather than its discursive naming as a precise sexual identity. The article concludes by asking for a reconceptualisation of the temporality of feminism not limited to its periodisation in the West, but informed by the specificities of feminist struggles locally and globally, including erotic autonomy as a viable praxis of decolonisation and a heightened self-reflexivity about the imperialist gestures guiding the production of (feminist) history and scholarship. Renewed philosophical discourse about virtue ethics motivates the search for examples to inform and extend our thinking. In the case of environmental virtue ethics, I have decided to consult “America’s Lifestyle Expert,” Martha Stewart. Oft dismissed as a pop icon or model of domesticity, Martha’s business success is arguably a result of her claimed authority on what the good life entails and how we get it. Reviewing over 60 signed “Letters From Martha” from her monthly magazine Martha Stewart Living. (MSL) (...) I explored her presentations of current environmental topics including biodiversity, obligations to animals, gardening, global warming, and reliance on technology. I find that her work ultimately makes managing a household interesting, and encourages her public to take personal pride in everyday tasks done well. These are trademark Martha Stewart “good things.” Moreover, by connecting with a large audience few philosophers or scientists ever court, she is poised to help us manage our larger planetary household (sensu Gr. “oikos”) and frame a quality of life for future generations. The use of Internet to aid research practice has become more popular in the recent years. In fact, some believe that Internet surveying and electronic data collection may revolutionize many disciplines by allowing for easier data collection, larger samples, and therefore more representative data. However, others are skeptical of its usability as well as its practical value. The paper highlights both positive and negative outcomes experienced in a number of e-research projects, focusing on several common mistakes and difficulties experienced by (...) the authors. The 1970s were marked by a resurgence of interest in the enigmatic figure known as Pseudo-Dionysius the Aeropagite. Yet the accessibility of his works, in readable and accurate translations, continues to be a problem. Jones's translation is therefore welcome.

Recent evidence suggests that if a deterministic description of the events leading up to a morally questionable action is couched in mechanistic, reductionistic, concrete and/or emotionally salient terms, people are more inclined toward compatibilism than when those descriptions use non-mechanistic, non-reductionistic, abstract and/or emotionally neutral terms. To explain these results, it has been suggested that descriptions of the first kind are processed by a concrete cognitive system, while those of the second kind are processed by an abstract cognitive system. The (...) current paper reports the results of three studies exploring whether or not considerations about possible future consequences of holding an agent responsible at a present time affect people’s judgments of responsibility. The results obtained suggest first that the concrete system does not produce compatibilist judgments of responsibility unconditionally, even when facing appropriately mechanistic, reductionistic, emotionally loaded and concretely worded deterministic scenarios. Second, these results suggest that considerations about possible future consequences for innocent third parties that may follow as a result of holding an agent responsible affect people’s judgment as to whether or not the agent is responsible for what she did. Finally, it is proposed that these results compliment extant evidence on the so-called “Side-effect effect”, as they suggest that emotional reactions toward possible future side effects influence people’s judgment of responsibility. The impact of these results for philosophy and moral psychology is discussed. (shrink)

Current theories of breast cancer progression have been greatly influenced by the development and refinement of mouse transgenic and gene targeting technologies. Early transgenic mouse models confirmed the involvement of oncogenes, previously implicated in human breast cancer, by establishing a causal relationship between overexpression or activation of these genes and mammary tumorigenesis. More recently, the importance of genes located at sites of loss of heterozygosity in human breast cancer have been examined in mice by their targeted disruption via homologous recombination. (...) The union of these two approaches allows the generation of complex animal models that more accurately reflect the multistep nature of human breast cancer. Discovering the taxonomies that best describe emotional experience has been surprisingly challenging. Clore and Huntsinger propose that by exploring the objects of emotion, such as standards or actions, we may better understand differences in emotion that emerge for similarly valenced reactions. We are sympathetic to this idea, although we suggest here that greater attention should be given to the computations that accompany affective processing, such as the discrepancy between different hedonic states, rather than the object per se.

There has been a renewed interest in psychology and anthropology in the idea of altered states of consciousness. This paper begins by examining the meaning of this term and the extent to which such experiences are reported globally. The topic of shamanism is then discussed, first with respect to its social functions, and then to what is known about its psychological aspects (which is little). Far more is known about altered states of consciousness (ASCs) as they are expressed in meditation, (...) trance and possession, and channeling, and a number of studies are reviewed, both of individuals and of groups, which illustrate the full extent of ASCs. The following section then goes more deeply into the stimulus situations that are associated with ASCs. This brings the discussion into drugs, attempts at altering the sensorium (music and imagery in particular) and recent technological innovations, peculiar to our time, which deliberately alter our usual state of awareness through feedback principles. In the final section, what is known about the physiology of ASCs is reviewed and also the extent to which these phenomena, including shamanism, are regarded as pathological. As a great number of people across the world utilize the healing aspects of trance, possession and shamanic practices, this aspect is discussed, and lastly the adaptive functions of ASCs are considered, with their context in the history of psychology. We discuss the impact of horizontal gene transfer (HGT) on phylogenetic reconstruction and taxonomy. We review the power of HGT as a creative force in assembling new metabolic pathways, and we discuss the impact that HGT has on phylogenetic reconstruction. On one hand, shared derived characters are created through transferred genes that persist in the recipient lineage, either because they were adaptive in the recipient lineage or because they resulted in a functional replacement. On the other hand, taxonomic patterns in (...) microbial phylogenies might also be created through biased gene transfer. The agreement between different molecular phylogenies has encouraged interpretation of the consensus signal as reflecting organismal history or as the tree of cell divisions; however, to date the extent to which the consensus reflects shared organismal ancestry and to which it reflects highways of gene sharing and biased gene transfer remains an open question. Preferential patterns of gene exchange act as a homogenizing force in creating and maintaining microbial groups, generating taxonomic patterns that are indistinguishable to those created by shared ancestry. To understand the evolution of higher bacterial taxonomic units, concepts usually applied in population genetics need to be applied. (shrink)

The harmonious free play of the imagination and understanding is at the heart of Kant’s account of beauty in the Critique of the Power of Judgement, but interpreters have long struggled to determine what Kant means when he claims the faculties are in a state of free play. In this article, I develop an interpretation of the free play of the faculties in terms of the freedom of attention. By appealing to the different way that we attend to objects in (...) aesthetic experience, we can explain how the faculties are free, even when the subject already possesses a concept of the object and is bound to the determinate form of the object in perception. Institutional review boards are almost universally considered to be overworked and understaffed. They also require substantial commitments of time and resources from their members. Although some surveys report average IRB memberships of 15 people or more, federal regulations require only five. We present data on IRB meetings at eight of the top 25 academic medical centers in the United States funded by the National Institutes of Health. These data indicate substantial contributions from primary reviewers and chairs during protocol discussions but (...) little from other members, which implies that it may be possible for smaller IRBs to accomplish the same tasks with no reduction in the quality of review. During the period covered by this book, George Santayana had settled permanently in Rome. His best-selling novel, The Last Puritan, was published in London in 1935 and in the United States in 1936, where it was chosen as a Book-of-the-Month Club selection. In 1936 Santayana became one of the few philosophers ever to appear on the front cover of Time magazine. His growing influence was evidenced further by two other 1936 publications, Obiter Scripta: Lectures, Essays and Reviews and Philosophy of (...) Santayana: Selections From the Works of George Santayana. Also during this year the first six volumes of the Triton Edition, a limited signed edition with significant new prefaces, was published by Scribner's. Like many recent works in legal theory, especially those focusing on the apparently conflicting schools of legal positivism and natural law, Waluchow’s Inclusive Legal Positivism begins by admitting a degree of perplexity about the field; indeed, he suggests that the field has fallen into “chaos”. Disturbingly, those working within legal theory appear most uncertain about what the tasks of their field are. Legal philosophers often seem to suspect strongly that at least their colleagues in the field are confused about those (...) tasks. As a result, many recent books in legal theory are in large part exercises in legal metatheory, devoting many pages to attempts to define the purposes and goals of the field. Waluchow follows this trend and begins by expressing a desire to clarify the issues that separate those trying to give an account of the nature of law. His ultimate goal is to defend a version of legal positivism, inclusive legal positivism, that he thinks is at least implicit in H. L. A. Hart’s work. (shrink)
